1. Acceptance of Terms
By accessing or using MetadataMonster ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.
2. Service Description
MetadataMonster is a free, browser-based tool that lets you inspect and remove metadata (EXIF, GPS, IPTC, XMP, and other embedded data) from image files. The Service consists of:
- Browser-based processing: all file analysis and metadata removal happens locally in your web browser. No files are uploaded to any server.
- Anonymous processing statistics: when you remove metadata, the file format and the categories of metadata removed (e.g. "EXIF", "GPS") are sent to our server as anonymous aggregate counters. No file content, metadata values, or identifying information is included. See our Privacy Policy for details.
3. Eligibility
You must be at least 16 years of age to use this Service. By using the Service, you represent that you meet this minimum age requirement. This threshold complies with the age of digital consent under German law (BDSG §8 in conjunction with Art. 8 GDPR).
6. Acceptable Use
You agree not to use the Service to:
- Process files you do not have the legal right to modify.
- Remove metadata for the purpose of concealing the origin of stolen or illegally obtained content.
- Circumvent copyright protections or digital rights management systems.
- Interfere with or disrupt the Service or its infrastructure.
- Attempt to gain unauthorised access to any part of the Service or its systems.
- Use automated means to access the Service beyond the provided API, including scraping or crawling.
7. Intellectual Property
The Service, its design, code, and documentation are the intellectual property of MetadataMonster. You retain full ownership of all files you process. We claim no rights over your files or their contents.
8. No Warranty
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. In particular, we do not warrant that:
- Metadata removal will be complete for all file types, formats, or edge cases.
- The Service will be uninterrupted, error-free, or free from security vulnerabilities.
- Results will meet your specific requirements.
Always verify that metadata has been fully removed before sharing sensitive files.
9. Limitation of Liability
To the maximum extent permitted by applicable law, MetadataMonster shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to data loss, privacy breaches, incomplete metadata removal, or loss of profits, arising from your use of the Service.
Nothing in these terms excludes or limits liability for fraud, intentional misconduct, or any liability that cannot be excluded or limited under applicable law, including German civil law (BGB) mandatory provisions.
10. User Responsibility
You are solely responsible for:
- The files you process and how you use the output.
- Ensuring you have the legal right to modify any files you upload.
- Verifying that metadata removal is complete before distributing processed files.
- Keeping any backup copies of your original files before processing.
11. Service Availability and Modifications
We may modify, suspend, or discontinue the Service (or any part of it) at any time without prior notice. The Service is provided free of charge and we do not guarantee any specific level of availability, uptime, or support.
13. Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law provisions. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Germany.
If you are a consumer residing in the EU, you are additionally entitled to bring proceedings in the courts of your place of residence and benefit from the mandatory consumer protection provisions of your local law.
14. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that achieves the original intent as closely as possible.
15. Changes to Terms
We may update these terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the updated terms.
